WHAT ARE PREGNANCY PROTECTIONS?

The Pregnancy Discrimination Act of 1978 ("PDA")is a federal law that prohibits discrimination or harassment in the workplace based on pregnancy, childbirth, or related medical conditions.  

The Pregnant Workers Fairness Act ("FWFA") requires covered employers to provide reasonable accommodations to employees based on known limitations due to pregnancy, childbirth, or related medical conditions, but prohibits an employer from requiring an employee to take accommodations not needed or to take leave if another accommodation is reasonably available.

The Americans with Disabilities Act provides additional protections from discrimination based on pregnancy related disabilities.
